1. Agreement to Terms
Welcome to New Life ("we," "us," "our," or "New Life Monitoring LLC"). These Terms of Service ("Terms") govern your access to and use of our macOS application, website, and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, INCLUDING MANDATORY ARBITRATION AND CLASS ACTION WAIVER PROVISIONS IN SECTION 15.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age. We do not knowingly collect information from or direct any of our content specifically to anyone under the age of 18.
3. Description of Service
New Life is an accountability and monitoring service that:
- Captures screenshots of your macOS device for content monitoring purposes
- Uses artificial intelligence to analyze screenshots for adult content detection
- Sends notifications and reports to you and your designated accountability partners
- Provides a web-based dashboard for reviewing activity history
- Facilitates accountability partnerships for personal development and behavioral improvement
The Service is intended for personal use to help users monitor their own device usage with the support of accountability partners.
4. Account Registration and Security
4.1 Account Creation
To use the Service, you must create an account by providing accurate and complete information, including a valid email address. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and complete
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
4.2 Account Responsibility
You are responsible for all activities that occur under your account. You agree not to:
- Share your account credentials with others
- Allow others to use your account
- Create more than one account for yourself
- Create an account using false or misleading information
4.3 Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion, with or without notice.
5. Subscription and Payment Terms
5.1 Subscription Plans
The Service requires a paid subscription to access full features. We offer the following subscription options:
- Free trial (14 days)
- Monthly subscription
- Yearly subscription
5.2 Free Trial
New users are eligible for a 14-day free trial. You may only use one free trial per account. If you do not cancel before the end of the trial period, you will automatically be charged for the subscription plan you selected.
5.3 Billing and Charges
- All payments are processed through Stripe, our third-party payment processor
- Subscriptions are automatically renewed at the end of each billing period unless cancelled
- You authorize us to charge your payment method for all fees associated with your subscription
- All fees are non-refundable except as required by law or as expressly stated in these Terms
- Prices are subject to change with notice. Price changes will apply to subsequent billing periods
5.4 Automatic Renewal
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You will be charged the then-current subscription fee.
5.5 Cancellation
You may cancel your subscription at any time through:

- The Stripe Customer Portal
- By contacting us at newlifemonitorapp@gmail.com
Upon cancellation:
- You will retain access to the Service until the end of your current billing period
- No refunds will be provided for partial billing periods
- Your subscription will not renew for the next billing period
5.6 Refund Policy
All fees are non-refundable except as required by applicable law. We do not provide refunds or credits for:
- Partial billing periods
- Unused subscription time
- Subscriptions cancelled before the end of a billing period
- Features or functionality you did not use
5.7 Payment Disputes
If you initiate a payment dispute, chargeback, or payment reversal through your financial institution or payment service provider without first contacting us to resolve the issue, we reserve the right to immediately suspend or terminate your account access.
Before disputing any charge, we require that you contact us at newlifemonitorapp@gmail.com to discuss the matter. We are committed to resolving legitimate billing concerns fairly and promptly. Bypassing this requirement and proceeding directly to a chargeback may be treated as a material breach of these Terms and may result in loss of access to the Service.
6. Acceptable Use Policy
6.1 Permitted Use
You may use the Service only for lawful purposes and in accordance with these Terms.
You certify that:
- You are the legal owner of all devices on which you install and use the Service, OR you have received explicit authorization from the device owner to install and use monitoring software on their device
- You will use the Service solely for personal accountability and self-monitoring purposes
- Your use of the Service complies with all applicable federal, state, local, and international laws and regulations
6.2 Prohibited Use
You agree NOT to:
- Use the Service to monitor any device or person without their knowledge and explicit consent
- Monitor devices owned by others, including spouses, children, employees, or any third party, without proper legal authorization
- Use the Service in any way that violates any applicable law or regulation
- Use the Service for any commercial purpose without our express written consent
- Attempt to circumvent, disable, or interfere with security-related features
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service
- Use any automated system to access the Service in a manner that sends more requests than a human can reasonably produce
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service, other accounts, or systems
- Use the Service to transmit any viruses, malware, or other malicious code
- Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
- Harass, abuse, threaten, or intimidate any person through the Service
- Collect or store personal data about other users without their consent
- Use the Service in any way that could damage our reputation or business
6.3 Consequences of Violation
Violation of this Acceptable Use Policy may result in:
- Immediate suspension or termination of your account
- Legal action
- Reporting to appropriate law enforcement authorities
- No refund of any fees paid
6.4 Law Enforcement Cooperation
If we become aware of potentially illegal activity through our Service—including but not limited to child sexual abuse material (CSAM) or other criminal content—we may:
- Report such activity to relevant law enforcement authorities
- Provide evidence and user information to law enforcement when requested or as legally required
- Cooperate fully with criminal investigations
- Take immediate action to suspend or terminate accounts involved in suspected illegal activity
We are committed to maintaining the safety and legality of our platform and will not hesitate to work with authorities when criminal activity is suspected.
7. Screenshot and Monitoring
7.1 Your Consent
By using the Service, you explicitly consent to the capture, processing, and analysis of screenshots from your device. You acknowledge and agree that:
- Screenshots will be captured periodically while the Service is active
- Screenshots will be analyzed using artificial intelligence for adult content detection
- Screenshots and detection results will be shared with your designated accountability partners
- A subset of screenshots (in blurred form) may be stored for review by you and your accountability partners
7.2 Your Responsibilities
You are solely responsible for:
- Ensuring you have the legal right to use monitoring software on your device
- Ensuring no third-party rights are violated by screenshot capture
- Understanding that you are monitoring your own device and not others
- Any content captured in screenshots, including sensitive or confidential information
- Managing who has access to your accountability data
- Regularly verifying that the Service is operating correctly on your device
Screenshots captured by the Service may include copyrighted materials, trade secrets, confidential information, or other proprietary content. You bear full responsibility for all content that appears in your screenshots. We make no claim to and expressly disclaim any ownership interest in copyrighted or proprietary materials that may be captured during your use of the Service.
7.3 AI Detection Limitations
You acknowledge and agree that:
- The artificial intelligence detection is not 100% accurate
- False positives and false negatives may occur
- We do not guarantee the accuracy, reliability, or completeness of detection results
- Detection results should be used as a tool and not as definitive proof
- We are not liable for incorrect detection results
7.4 Data Results, Not Interpretations
Important: All information provided by the Service—including screenshots, detection results, event logs, activity summaries, and any classifications or labels (such as detection scores or event descriptions)—constitutes raw data and algorithmic output, not interpretations, judgments, or conclusions about your behavior, intentions, or character.
You and your accountability partners are solely responsible for interpreting and understanding the context and meaning of all data provided by the Service. We do not, and cannot, make assessments about:
- Your motivations or intentions
- Patterns of behavior or habits
- The appropriateness or inappropriateness of any specific content for you
- Whether any particular activity constitutes a problem or concern
Legal Use Limitation: The Service and its reports are designed and intended exclusively for personal accountability and self-improvement purposes within the context of supportive relationships. The Service is not designed, intended, or suitable for use as evidence in legal proceedings, employment decisions, custody disputes, probation/parole monitoring, or any other legal or judicial context. We expressly disclaim any responsibility for such uses and strongly discourage relying on Service data for any legal purposes.
7.5 No Monitoring of Third Parties
The Service is intended solely for self-monitoring. You agree NOT to:
- Use the Service to monitor other people's devices without their explicit knowledge and consent
- Use the Service to spy on, track, or surveil others
- Violate anyone else's privacy rights through use of the Service
7.6 Service Reliability and User Responsibility
It is your responsibility to confirm that the Service is working correctly on your device. This responsibility includes:
- Checking that screenshots are being recorded as expected
- Ensuring the application remains active and properly connected
- Verifying that data is successfully reaching our servers
- Addressing any technical problems that may interrupt service functionality
While we provide monitoring tools, we do not guarantee uninterrupted or continuous monitoring. Many factors beyond our control can affect monitoring, such as:
- Changes to device permissions or system configurations
- Software updates to your operating system
- Internet or network connection problems
- Device power or battery management features
- Antivirus or security software blocking functionality
- Actions you or others take that affect the application
- Unforeseen technical issues or compatibility problems
Refunds will not be provided in situations where monitoring was interrupted, failed, or did not function as expected, regardless of the cause. You agree that maintaining proper operation of the Service on your device is your obligation, and you will regularly check to ensure it is working correctly.
8. Accountability Partners
8.1 Partner Invitations
You may invite accountability partners who will receive notifications and reports about your activity. By inviting partners, you:
- Consent to sharing your monitoring data with those partners
- Acknowledge that partners will receive email notifications about your activity
- Acknowledge that partners can view your blurred screenshots and event history
- Take full responsibility for your choice of accountability partners
8.2 Partner Responsibilities and Limitations
You acknowledge that:
- You are solely responsible for selecting appropriate accountability partners
- We have no control over how partners use or share the information they receive
- We are not responsible for any disputes, conflicts, or issues arising from accountability partnerships
- We are not liable for any actions taken by your accountability partners based on information they receive
- Partners act as independent individuals, not as our agents or representatives
8.3 Removing Partners
You may remove accountability partners at any time, which will:
- Stop them from receiving new notifications about your activity
- Prevent them from accessing your activity data going forward
- Not delete historical data they have already received
9. Intellectual Property Rights
9.1 Our Ownership
The Service and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by New Life Monitoring LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
9.2 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
- Download and install the macOS application on devices you own or control
- Access and use the Service for your personal, non-commercial use
This license does not include any right to:
- Resell or make commercial use of the Service
- Modify or make derivative works of the Service
- Download (other than page caching) or copy any account information for the benefit of another party
- Use any data mining, robots, or similar data gathering or extraction methods
9.3 Restrictions
You may not:
- Copy, modify, create derivative works of, publicly display, publicly perform, republish, or transmit any of the material obtained from the Service
- Remove or alter any copyright, trademark, or other proprietary rights notices
- Access or use the Service in any way not expressly permitted by these Terms
9.4 Trademarks
The name "New Life," our logo, and all related names, logos, product and service names, designs, and slogans are trademarks of New Life Monitoring LLC. You may not use such marks without our prior written permission.
10. Third-Party Services
10.1 Third-Party Providers
The Service integrates with and relies upon third-party services, including:
- Firebase (Google) for authentication, database, and file storage
- Stripe for payment processing
- Resend for email delivery
- Microsoft Application Insights for analytics
10.2 Third-Party Terms
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or practices of third-party service providers.
10.3 No Warranties for Third-Party Services
We make no warranties or representations about the accuracy, reliability, completeness, or timeliness of third-party services. We are not liable for any errors, omissions, or other defects in third-party services.
11. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you also agree to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at https://newlifemonitoring.com/Home/PrivacyPolicy.
11.1 Customer Support and Data Access
When you contact us for customer support, technical assistance, or help understanding your account data, screenshots, reports, or Service functionality, your request for assistance constitutes explicit permission for us to access and review your account information, activity data, screenshots, reports, and any other information necessary to provide the requested support.
We will only access your data for the specific purpose of responding to your support request. While we may retain records of support communications (including emails, chat logs, and descriptions of issues), we will handle your activity data in accordance with our standard data retention policies as described in our Privacy Policy.
If you do not wish to grant us access to specific data, please do not submit a support request about that data, or clearly indicate in your request which information you do not want us to access.
12. Disclaimers and Limitations of Liability
12.1 "AS IS" Disclaimer
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEW LIFE MONITORING LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
- WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INFORMATION, OR DETECTION RESULTS
12.2 No Guarantee of Results
We do not guarantee that:
- The Service will help you achieve any particular outcome or behavioral change
- AI detection will be 100% accurate
- The Service will prevent any particular behavior
- Accountability partnerships will be effective
- Your goals will be achieved through use of the Service
12.3 Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEW LIFE MONITORING LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE
- ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING ACCOUNTABILITY PARTNERS
- ANY CONTENT OBTAINED FROM THE SERVICE
- UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
- ANY ERRORS, MISTAKES, OR INACCURACIES IN DETECTION RESULTS
- ANY DISPUTES OR ISSUES ARISING FROM ACCOUNTABILITY PARTNERSHIPS
- ANY DAMAGE TO YOUR RELATIONSHIPS, REPUTATION, SOCIAL STANDING, OR PERSONAL STANDING ARISING FROM ACCOUNTABILITY PARTNER ACCESS TO YOUR DATA OR USE OF THE SERVICE
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NEW LIFE MONITORING LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID TO NEW LIFE MONITORING LLC IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING THE SERVICE AND CANCEL YOUR SUBSCRIPTION.
12.4 Acknowledgment
You acknowledge that these disclaimers and limitations of liability are essential elements of the agreement between you and New Life Monitoring LLC, and that we would not provide the Service to you without these limitations.
13. Indemnification
You agree to defend, indemnify, and hold harmless New Life Monitoring LLC, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Service
- Your violation of any rights of another party, including any accountability partners
- Your violation of any applicable laws or regulations
- Any content you submit or transmit through the Service
- Your use of the Service to monitor devices without proper authorization
- Any disputes with accountability partners
14. Modification and Termination
14.1 Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:
- Posting the updated Terms on our website
- Updating the "Last Updated" date
- Sending you an email notification (for significant changes)
Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
14.2 Changes to Service
We reserve the right to:
- Modify, suspend, or discontinue any aspect of the Service at any time
- Change or impose fees for features that are currently free
- Limit or restrict access to certain features
- Change subscription pricing with notice (applies to new billing periods)
14.3 Termination by You
You may terminate your account at any time by:
- Cancelling your subscription
- Contacting us at newlifemonitorapp@gmail.com
- Following the account deletion process in our Privacy Policy
14.4 Termination by Us
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including:
- Breach of these Terms
- Violation of our Acceptable Use Policy
- Suspected fraudulent or illegal activity
- At our sole discretion for any other reason
14.5 Effect of Termination
Upon termination:
- Your right to use the Service will immediately cease
- We may delete your account and all associated data in accordance with our Privacy Policy
- You will not be entitled to any refunds
- All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability
15. Dispute Resolution
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
15.1 Governing Law
These Terms and any dispute arising out of or related to the Service shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions.
15.2 Mandatory Arbitration
Except for disputes that qualify for small claims court, any dispute, controversy, or claim arising out of or relating to these Terms or the Service (including the breach, termination, enforcement, interpretation, or validity thereof) shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules.
By agreeing to these Terms, you are waiving your right to a trial by jury.
15.3 Pre-Arbitration Informal Resolution
Before commencing arbitration proceedings, you agree to attempt informal resolution by contacting us directly. Send a detailed notice to newlifemonitorapp@gmail.com that includes:
- Your full name
- The email address linked to your account
- A comprehensive explanation of the issue and the facts supporting your position
- The specific outcome or remedy you are requesting
We will have 60 days from receiving your notice to work toward resolving the matter. If we cannot reach a mutually acceptable resolution within this timeframe, you may proceed with formal arbitration. This informal resolution process is mandatory and must be completed before any arbitration can begin.
15.4 Arbitration Process
- The arbitration will be conducted in Michigan or remotely via video conference
- The arbitrator will apply Michigan law
- The arbitrator's decision will be final and binding
- Judgment on the award may be entered in any court having jurisdiction
- Each party will bear its own attorney fees and costs unless otherwise awarded by the arbitrator
15.5 Class Action Waiver
YOU AND NEW LIFE MONITORING LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Unless both you and New Life Monitoring LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
15.6 Opt-Out of Arbitration
You have the right to opt out of the arbitration agreement. If you wish to opt out, you must notify us in writing within 30 days of the date you first accept these Terms (the "Opt-Out Deadline").
To opt out, send an email to newlifemonitorapp@gmail.com with the subject line "Arbitration Opt-Out" and include:
- Your full name
- Your email address associated with your account
- A clear statement that you wish to opt out of the arbitration provisions in these Terms
If you opt out:
- The arbitration provisions in Section 15 will not apply to you
- You will retain your right to resolve disputes through court proceedings
- All other terms of these Terms will continue to apply
Important: Opt-out notices received after the 30-day deadline will not be valid, and you will be bound by the arbitration provisions. If you create a new account after opting out, that opt-out will carry over to your new account.
15.7 Exceptions to Arbitration
Even if you do not opt out, either party may bring a lawsuit in court for:
- Claims that qualify for small claims court jurisdiction
- Claims seeking injunctive or equitable relief for intellectual property infringement or misappropriation of trade secrets
15.8 Exclusive Jurisdiction
For any disputes not subject to arbitration (including if you have opted out of arbitration), you agree to submit to the exclusive jurisdiction of the state and federal courts located in Michigan, and you waive any objection to venue in such courts.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and New Life Monitoring LLC regarding the Service and supersede all prior agreements and understandings, whether written or oral.
16.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
16.3 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms or your rights under these Terms, in whole or in part, without our prior written consent. We may assign these Terms or any rights under these Terms without your consent. Any attempted assignment in violation of this section shall be void.
16.5 Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
16.6 Electronic Communications
By using the Service, you consent to receiving electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Email Communication Limitations: While we take reasonable measures to secure our communications, we cannot guarantee the security of information transmitted via email. Email communications may be subject to interception, unauthorized access, delays, corruption, loss, or technical failures. Email messages may arrive late, incomplete, or not at all, and may contain errors or be affected by viruses or other malicious code.
By providing your email address and using the Service, you acknowledge these risks and agree that:
- We are not responsible for any breach of security, unauthorized interception, or technical failure affecting email communications
- We are not liable for any consequences arising from delayed, failed, or compromised email delivery
- You are responsible for maintaining the security of your email account and device
- If email communications contain sensitive information (such as screenshots or activity alerts), you should take appropriate precautions to protect your email account
16.7 U.S. Government Rights
If you are a U.S. government entity, the Service is a "commercial item" as defined at 48 C.F.R. §2.101, and you acquire only those rights specified in these Terms.
16.8 Relationship of Parties
You and New Life Monitoring LLC are independent contractors. These Terms do not create any partnership, joint venture, employment, or agency relationship between you and us.
16.9 Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person other than you and New Life Monitoring LLC.
16.10 Equitable Relief
You acknowledge that your breach of these Terms may cause irreparable harm to New Life Monitoring LLC for which monetary damages would be an inadequate remedy. Accordingly, we shall be entitled to seek equitable relief, including injunction and specific performance, for any breach or threatened breach of these Terms.
